Company Policy on Personal Data Protection

"AGIVA" Ltd. is the data controller within the meaning of the General Data Protection Regulation (Regulation (EU) 2016/679). You can contact the Data Controller at the following address: Aksakovo, Varnenski Path.

"AGIVA" Ltd. undertakes to comply with applicable data protection laws, including but not limited to, the General Data Protection Regulation, the Personal Data Protection Act, and subordinate legislation issued based on it.

"AGIVA" Ltd. respects the integrity and protects the personal data of its employees and contractors during processing.

"AGIVA" Ltd. has taken the necessary organizational and technical measures to protect personal data.

"AGIVA" Ltd. processes only properly collected personal data necessary for specific, clearly defined, and lawful purposes:

  • Individualization of data subjects upon their entry into labor and civil legal relationships with the Administrator, performance of the Administrator's statutory and contractual obligations arising from its capacity as an employer/principal;
  • Conclusion and performance of obligations under contracts concluded by the Administrator related to its activities;
  • Compliance with regulatory obligations of the Administrator related to its activities;
  • Other purposes requiring the processing of personal data by the Administrator, whereby the Administrator is obliged to establish the legal basis for processing within the meaning of Article 6 of the General Data Protection Regulation (Regulation (EU) 2016/679) in each case.

Personal data collected and processed by "AGIVA" Ltd. should be accurate and, if necessary, updated. Personal data are deleted or corrected when it is found that they are inaccurate or inconsistent with the purposes for which they are processed.

"AGIVA" Ltd. stores and processes collected personal data for a period not exceeding that necessary for the purposes for which the personal data were collected.

"AGIVA" Ltd. adheres to the general prohibition on processing special categories of personal data, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of trade unions, as well as the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a person's sex life or sexual orientation. When necessary to achieve the purposes of processing, "AGIVA" Ltd. processes sensitive personal data strictly in accordance with legal requirements.

Individuals whose personal data is processed by "AGIVA" Ltd. have the following rights:

  • Right to information about their personal data processed by "AGIVA" Ltd.;
  • Right to access their personal data processed by "AGIVA" Ltd.;
  • Right to correct inaccurate personal data processed by "AGIVA" Ltd.;
  • Right to erasure of personal data ("right to be forgotten");
  • Right to restrict the processing of their personal data;
  • Right to data portability.

The aforementioned rights of data subjects can be exercised by:

  • Sending a request personally or through an authorized person to the email address gdpr@agiva.net. The request must be signed in accordance with the Electronic Document and Electronic Signature Act.

"AGIVA" Ltd. may provide personal data if and to the extent necessary to third parties:

  • to achieve the purposes for which the relevant categories of personal data were collected;
  • in compliance with a legal obligation;
  • to protect the rights and safety of "AGIVA" Ltd., our employees, and contractors.

In case of violation of the rights of data subjects, each of them has the right to protection, which can be exercised by:

  • referring the matter to the Commission for Personal Data Protection;
  • appealing actions and acts of the personal data controller through judicial proceedings before the respective Administrative Court or the Supreme Administrative Court according to the general rules of jurisdiction.
